1. Acceptance of Terms

By creating an account, downloading our mobile application, or using any BetLens services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

2. Description of Service

BetLens is an AI-powered sports betting analysis platform that provides:

• AI-generated betting insights and recommendations
• Live sports odds and statistics aggregation
• Team performance analytics and trends
• Educational content for sports betting strategies

3. Eligibility and Age Requirements

To use BetLens, you must:

• Be at least 21 years of age (or the legal gambling age in your jurisdiction, whichever is higher)
• Be located in a jurisdiction where sports betting is legal
• Comply with all applicable local, state, and federal laws regarding sports betting
• Have the legal capacity to enter into this agreement

You represent and warrant that you meet all eligibility requirements. BetLens reserves the right to verify your age and location at any time.

4. Account Registration and Security

Account Creation

• Provide accurate, complete, and current information
• Maintain the security of your password
• Notify us immediately of unauthorized access
• Accept responsibility for all activities under your account

Account Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Provide false or misleading information
• Engage in fraudulent or illegal activities
• Are under the legal gambling age

5. Subscription and Payment Terms

Subscription Plans

BetLens offers the following subscription options:

• Football Analysis: AI insights for NFL and College Football
• Basketball Analysis: AI insights for NBA and College Basketball
• Both Sports Bundle: Access to all football and basketball analysis

Payment Processing

All payments are processed securely through Gumroad. By subscribing, you agree to Gumroad's terms and conditions. BetLens does not store or process payment information directly.

License Keys

• You will receive a unique license key upon purchase
• License keys are non-transferable and for single-user use only
• Sharing license keys is prohibited and may result in termination
• Each sport requires a separate license key unless bundled

Billing and Renewal

• Subscriptions auto-renew unless cancelled before the next billing cycle
• Prices may change with 30 days' notice to existing subscribers
• No refunds for partial months or unused time
• Cancelled subscriptions remain active until the end of the billing period

Refund Policy

Refunds are handled by Gumroad according to their refund policy. Contact Gumroad support for refund requests. BetLens reserves the right to deny service to users who abuse refund policies.

6. Prohibited Uses

You agree NOT to:

• Use BetLens if you are under 21 years of age
• Use the service in jurisdictions where sports betting is illegal
• Share, sell, or distribute your license key
• Reverse engineer, decompile, or attempt to extract source code
• Use automated systems (bots, scrapers) to access the service
• Interfere with or disrupt the service or servers
• Impersonate another user or provide false information
• Use the service for illegal gambling or money laundering
• Redistribute or resell BetLens content or analysis

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• BetLens and its owners, employees, and partners shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages
• This includes damages for loss of profits, revenue, data, or other intangible losses
• Our total liability shall not exceed the amount you paid for the service in the past 12 months
• We are not responsible for losses from betting decisions based on our analysis
• We are not liable for third-party service failures (Gumroad, TheOddsAPI, etc.)

9. Intellectual Property Rights

BetLens Content

All content, including but not limited to text, graphics, logos, AI analysis, software, and data compilations, is the property of BetLens and protected by copyright, trademark, and other intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable license to:

• Access and use BetLens for personal, non-commercial purposes
• View AI analysis and recommendations for your own betting decisions

Restrictions

You may NOT:

• Reproduce, distribute, or publicly display BetLens content
• Create derivative works or modifications
• Use content for commercial purposes without written permission
• Remove copyright or proprietary notices

10. Third-Party Services

BetLens integrates with third-party services (Anthropic AI, TheOddsAPI, Gumroad, ESPN, Google Sheets). We are not responsible for:

• Availability or performance of third-party services
• Accuracy of third-party data (odds, scores, statistics)
• Privacy practices of third-party providers
• Changes or discontinuation of third-party APIs

11. Data and Privacy

Your use of BetLens is also governed by our Privacy Policy. By using the service, you consent to our collection and use of your information as described in the Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting with an updated "Last Updated" date. Continued use after changes constitutes acceptance of modified terms.

Material changes will be communicated via:

• Email notification to your registered email address
• In-app notification
• Prominent notice on our website

13. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or use of BetLens shall be resolved through:

1. Informal Negotiation: Contact us at betlensinsights@gmail.com to attempt resolution
2. Binding Arbitration: If negotiation fails, disputes shall be resolved by binding arbitration under the American Arbitration Association rules
3. Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and BetLens regarding use of the service, superseding any prior agreements.
